This document constitutes both (1) the general terms, conditions and notices or the terms of use of Blossombaydecor.com that govern the use of Blossombaydecor.com, including the conclusion of a sales contract with us, and (2) the seller-customer agreement for sale through Blossombaydecor.com.

Terms of Use

This website is offered to you, the customer, by Gilly International Ltd and is conditional on your acceptance without change of the terms, conditions and notices contained here. Your use of this website means you agree to all such terms, conditions and notices. We may change or update these terms so please check this page regularly. Gilly International Ltd does not guarantee the accuracy of, and disclaim liability for inaccuracies relating to the information and description of any product displayed on this website. We reserve the right to correct any errors or omissions, and to change or update information at any time without prior notice.

Liability Disclaimer

Gilly International Ltd disclaim all warranties, terms and conditions with regard to this information, software, products, and services, including all implied warranties and conditions of suitable quality, fitness for a particular purpose, title and non-infringement.

In no event shall Gilly International Ltd or their suppliers be liable for any, indirect, incidental, punitive, special, or consequential damages arising out of or any way connected with the use of this website or with the delay or inability to use this website, or for any information, products and services obtained through this website, or otherwise arising out of the use of this website.

This agreement is governed by the laws of the Republic of Bulgaria. You hereby consent to the exclusive jurisdiction of the Bulgarian courts in all disputes arising out of or relating to the use of this website. Use of this website is unauthorized in any jurisdiction that does not give effect all provisions of these terms and conditions, including without limitation this paragraph.

Neither party will be held liable for non-performance of its obligations if such non-performance is due to force majeure. Force majeure is an unpredictable event beyond the control of the parties that cannot be avoided. If force majeure does not cease within 14 (fourteen) days of the date of the event, each party has the right to notify the other party that it will terminate the agreement without incurring compensation for any possible damage.

Important: These terms and conditions and foregoing liability disclaimer, do not affect mandatory legal rights that cannot be excluded under applicable law.

Indemnification

You agree to defend and indemnify Gilly International Ltd and its affiliates, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:
1. Your breach of these website Terms and Conditions or the documents referenced herein;
2. Your violation of any law or the rights of a third party; or
3. Your use of this website.

As a condition of your use of this website, you warrant to Gilly International Ltd that you will not use this website for any purpose that is unlawful or prohibited by these terms, conditions and notices.

All content and infrastructure of the website including text, graphics, logos, images, is property of Gilly International Ltd and is protected by European and international copyright laws. You may electronically copy and print hard copies of pages from this website solely for personal, non-commercial purposes related to placing an order or shopping with Blossombaydecor.com. Any other use of our website, including reproduction and internet links, is strictly prohibited without our prior written permission. Images on this site are incorporated for viewing purposes only and may not be saved or downloaded in any format.

Online Sales Policy

During registration and placing your order, by ticking the box "I accept the General Terms", the user makes an electronic statement within the meaning of the Electronic Document Act and declares that he/she is familiar with and accepts our Terms and Conditions.

Orders through the siteBlossombaydecor.com are accepted 24 hours a day and 7 days a week.

Blossombaydecor.com asks that you review your order carefully prior to submission, as it cannot be modified once submitted. You will receive an order confirmation at the conclusion of your order, as well as an email that summarizes your order number and order total.

To ensure customer security, no credit card number is ever stored in our system. Your will be redirected to the payment gateway where you will enter your credit card details. We accept the following methods of payment: Visa, MasterCard, PayPal, Direct Bank Transfer and Cash on Delivery through the courier companies we are working with. We do not accept e-cheques via PayPal. Items are charged to your credit card when your order is placed.

In the case of online payments or bank transfer payments, Gilly International Ltd do not bear any liability for any charges in connection with fees, commissions or other additional payments made by you or your bank for the transaction itself, as well as in the case of currency exchange applied by the bank issuing the card in cases where the currency is different from BGN.

The same applies to the transactions that Gilly International Ltd does to the client, whether doing so in connection with the recovery of any payment to the latter, or for any other reason. The costs associated with such payments are solely for the client’s expense. That is why we recommend our clients to consult with their bank about any additional fees that could be charged to them on online payments or on bank charges.

You confirm to us that you are authorized to use the payment method that you provide to us when placing your order. We may carry out security checking to confirm that this is the case. If your payment method is not authorized, we may refuse to accept your order and we will not have any responsibility for the non-delivery of the goods.

All images displayed on the site are solely intended to give some insight into the type of product offered, rather than to represent it accurately. Accordingly, some of the Products images (static/dynamic images, multimedia presentations etc.) may not match the appearance of the product in question. Gilly International Ltd will not be held responsible for such discrepancies.

Fabric color/shade can also vary slightly due to lighting, picture saturation and varies viewing devices such as mobile phones, computers, etc. 

We make each item by hand and made to order in our studio. Therefore, please allow us 3-7 working days so that we can make and send your order.

Formation of the contract

We will confirm our acceptance of your order for goods by sending you an email confirming that the goods have been dispatched (“Dispatch Confirmation”).

The contract between us will only be formed when we send you the Dispatch Confirmation (the “Contract”). These terms and conditions, the Dispatch Confirmation and any other information relating to the goods which we have brought to your attention are incorporated into the Contract.

The Contact will only relate to those goods which have been confirmed in the Dispatch Confirmation and we will not be obliged to supply any other goods which you have ordered until we have sent you a separate Dispatch Confirmation in respect of such goods.

Shipping

At this time, Gilly International Ltd will be shipping worldwide except to the following countries: North Korea, Somaliland, Turkmenistan, Afghanistan, Burundi, Iraq, Libya, Mali, Niger, South Sudan, Syria, Yemen, Central African Republic, Cote d’Ivoire, Democratic Republic of Congo, Eritrea, Iran, Liberia and Somalia.

We make each item by hand and made to order in our studio. Therefore, please allow us 3-7 working days so that we can make and send your order.

For Bulgaria we send all shipments with Econt Express AD. For orders to the rest of Europe we use local courier companies and for overseas orders we use DHL. Once shipped, you will receive your order within 4-14 business days.

Shipping time depends on your location. Please allow up to 8 business days although most orders are delivered earlier.

*Please note that for all shipments outside Bulgaria, the cash on delivery option is not available. All shipments to the European Union (excluding Bulgaria) and outside the European Union are paid by credit or debit card or by direct bank transfer when ordering.

Return Policy

As a consumer, you have the right to cancel the ordered goods within 14 WORKING DAYS of receipt of the goods, in case they are NOT USED, the integrity of their packaging is not violated and the goods are in the form in which they were received and under the conditions under Art. 55 of the Consumer Protection Act. The transport and other costs for receiving and returning the goods are at the expense of the consumer. Make sure to use a reputable shipping company with tracking information or proof of postage, as we are not responsible for lost or stolen packages.

Upon finding a defective product within 24 hours of receipt and intact commercial appearance of the goods and packaging, we undertake to replace it with a new one or to refund the value of the goods paid by you, according to Art. 55 of the Consumer Protection Act, in this case the transport and other costs of receiving and returning the goods are at the expense of the seller. In case of non-compliance of the goods with the characteristics indicated in the page with its description, the supplier refunds the entire amount paid by the consumer, according to art. 59 paragraph 3 of Consumer Protection Act and within 14 working days of receipt of the goods .

You must first contact us through the present Returns Form. Packages sent without contacting us beforehand will not be accepted. Note that you must ship the item back to us within 14 calendar days from the date you received the product. 

If you wish to exchange an item, you will need to return the item you no longer wish to keep and place a new order.

Purchase for Personal Use Only

You may purchase products from this site only for personal use and not for resale. By placing your order, you certify that you are purchasing products for personal use only and not for resale. We reserve the right to refuse orders for any reason without explanation.

Custom duties and export VAT

Standard Bulgarian VAT rate of 20% is charged to all orders within the European Union. This is included in the prices displayed on the site. For those countries that are outside the EU, VAT will be removed from the total of your order at the checkout stage. Please note that for those countries, you will be liable to pay the country’s VAT as well as any relevant import duties and taxes. Gilly International Ltd assumes no responsibility in those packages held in customs if those charges are not settled by the customer. The customer has the sole responsibility for the formal clearance of the order. For more information on taxes, duties and customs regulations please contact your local customs office directly.

Secure Processing

Blossombaydecor.com uses secure processing called SSL Encryption Technology, which is the industry standard. SSL (Secure Sockets Layer) is a protocol developed for the transmission of private information over the internet. SSL uses a private key to encrypt your data, including your credit card information, so that it cannot be read while being transferred over the internet.
